Centre all set to launch its own realty portal

NEW DELHI: Move over property portals. The government is set to launch one of its own, initially with about 50,000 residential properties that you can bid for online. These are properties that debt recovery tribunals (DRTs) have allowed banks to sell through auction after their owners defaulted on loan repayment. 


The government portal, which is yet to go live, will provide details such as the pictures and floor area of the properties and allow anyone to bid directly after electronically making the earnest money deposit. 
"We will list all such properties where there are no encumbrances and hold auction for them on an ongoing basis," said a senior government official with knowledge of the matter. "As of now, we have around 50,000 residential properties which are ready to be auctioned." The purpose of setting up a portal and holding electronic auctions is to make the process fair and transparent. "We have earlier received reports that in some cases auctions conducted by DRTs are controlled by certain groups and general public is not able participate in these auctions," the official said. The auction will be managed by MSTC, a public sector trading firm that eauctions commodities and assets ranging from human hair from the temple town of Tirupati to agriculture commodities and house plots. It also manages the government's auction of coal blocks.
Currently, banks advertise the auction of properties after the recovery officers issue the notice for sale. The new portal will remove banks from the auction process, although the sale proceeds will flow into their accounts for loan recovery. To participate in the auction, a person will have to first register on the portal by submitting the knowyour-customer (KYC) information, which includes PAN and Aadhaar number, a second government official said, explaining the proposed process. "Once you have registered, a one-time pin will be sent to your registered mobile for confirmation," he said. Registered users will be able to see all auctionrelated information. In the second round, the government will also auction commercial properties, the first official said.
"We are working on that; it may be a new portal or a separate section within this portal." The initiative is made at a time when the central bank has eased the rules for commercial banks to recover bad loans that are weighing heavily on their performance. The non-performing assets of state-run banks increased to 5.2% of their total outstanding loans at the end of March 2015 from 4.72% a year earlier, according to Reserve Bank of India data. Many of the debt recovery cases reach DRTs. Though DRTs are required to adjudicate on a case within 180 days, there are many which are pending for more than a decade.
 According to finance ministry data, there were about 59,000 cases pending before the nation's 33 DRTs at the end of 2014, involving assets worth Rs 3.7 lakh crore. DRTs annually dispose of 11,000 cases covering loans worth Rs 21,000 crore. With new debt-recovery regulations in place, more assets pledged by defaulting borrowers are expected to come to the market.
"Some of these cases have three or four properties which were mortgaged. These include both residential and commercial properties," the official said.

Pune's property market has always performed well in comparison to the other realty market. Amid slowdown in the realty sector, the Pune's realty market has still performed well and shown signs of growth. Pune's off city locations have supported to its growth with excellent infrastructure support.
According to the spokesperson of Kalpataru Ltd, "A rapidly increasing automobile ancillary industry and the growth of ITITeS sectors have been major growth indicators for Pune leading to a massive transformation of the city. Over the past few years, the city's IT sector has seen significant growth, leading to sustained demand for office spaces. With global majors having set up bases here, Pune is home to several major IT parks. This demand has seen the city's off-CBD locations of Magarpatta, Viman Nagar, Nagar Road, SB Road, Aundh, Baner, Shankar Seth Road, as well as the secondary business districts of Kharadi, Hadapsar, Hinjewadi, and Talawade becoming established as the hotspots for commercial offices".
Experts point out that with skyrocketing property values in the main city, development in Pune is seen to be moving towards peripheries. According to industry statistics, the maximum absorption of units launched in 2014 was seen towards the peripheral areas as against those within city limits.
Attractive off-city locations
"Pune has expanded along with its infrastructure and has demonstrated growth towards the western quadrant, due to the higher octane development of the IT and manufacturing hub of Hinjewadi and the adjoining areas. The new Ring Road and Metro Rail work well to complement an upward trend, and are poised to change the valuations for this market in the coming times", suggests Vinod Rohira, managing director, Commercial Real Estate & REIT, K Raheja Corp.
Experts suggest that Hadapsar is one such area which has undergone immense transformation. A locality with solely farms at one point in time, Hadapsar has seen a drastic makeover. Corporate biggies such as IBM, Accenture, TCS and SAS, to name a few, have their offices here located in the south-west region of Pune. Located on the fringes of east Pune, Wakad has grown considerably in the last half a decade. Young professionals largely prefer Wakad for its location in the developed Pimpri-Chinchwad Municipal Corporation (PCMC) and its comparative affordability to the neighbouring areas. Another important location is Baner. It is known for its impeccable infrastructural development and its excellent connectivity to Mumbai and other cities. The area offers good connectivity to arterial roads such as the Pune-Mumbai expressway and Pune-Bengaluru highway.
Social and physical infrastructure support
"Pune used to be accepted as a cultural capital. It is still likely to recall this title. The city is opening up new zones for real estate growth with the support of the city's road system. The infrastructure around the highway along with the service road on the sides and institutes like Symbiosis, works as additional features to attract the home seekers. Experts explain that considering the growth in IT sector, lots of people are moving towards Pune and people are looking for multi-storey apartments. Markets like Kharadi and Wagholi in east Pune and Pimple Nilakh, Pimple Saudagar and Wakad in West Pune are seeing a lot of residential projects and it provides a good connectivity with the key centres of the city along with the presence of good social arrangement like schools, hospitals, malls and entertainment centres. Investors are always eager to invest with the rapid connectivity improvements and successful social and civic infrastructure at these locations.

Registration provides safety and security to immovable properties

Registration provides safety to deals relating to immovable properties, even if the document is destroyed.
All the transactions related to immovable properties are governed by The Registration Act, 1908, The Transfer of Property Act, 1882 and other relevant laws. The Registration Act, 1908 requires compulsory registration of certain types of documents and also provides for consequences of non-registration. Registration provides safety and security to transactions relating to immovable properties, even if the document is lost or destroyed. The relationship between the landlord and the tenant, wherein the landlord transfers certain interest in his property to the tenant to use the particular property against the certain consideration i.e. called rent.
The Registration Act, 1908 has various provisions wherein documents have to get registered. It is open to the parties, if they so choose, to get certain documents registered at their option and this is permitted under section 18 (c) of the act, which deals with "leases of immovable property for any term not exceeding one year, and leases exempted under section 17" of The Registration Act, 1908. The parties and landlord prefer 11 months Leave and License Agreement which is valid in eyes of law and section 18 allowed the same under the provisions of The Registration Act, 1908.

The festive season coincides with the return of a positive outlook for realty sector and Ganpati festival gives it a boost.
Festival season this year is different for the real estate sector as developers are betting on the renewed market sentiment coupled with tradition to see their sales counters abuzz with activity. The positivity has already begun with Ganesh Chaturthi and hopes are held for the upcoming festivities to last until Diwali.
"The festive season is considered a peak time by developers, since 25-35 percent of their annual sales happen in this relatively short period," avers Jatin Patel, marketing manager of a real estate firm. As always, developers have lined up various offers to sweeten the deal for buyers. "Serious inquiries and sales have already increased by 15 percent at the beginning of this festive season. Also, it seems the additional sales momentum will be maintained at a steady 20-22 percent even after the festive season is over," says Pradeep Singh, a local real estate developer.
The market has witnessed sales to the extent that developers expect that if one goes by the trends during Ganesh Chaturthi, this year will end on a good note. "There has been significant response and bookings at this Ganpati festival. Even investors are seen making use of freebies, discounts and making investments wisely," says Parag Tyagi, a property consultant.
However, buyers are playing smart and scanning the market for the best of deals. "If the offer translates into savings on the bottom line, such as hard discount, free parking space that we would otherwise have had to pay for or waived stamp duty and registration charges, we intend to definitely consider it as long as the property itself meets our real needs and measures up on key investment parameters," says Nishit Mehta, a hotelier who intends to invest in real estate soon.

Rupee strengthens 9 paise against dollar in early trade

MUMBAI: The rupee appreciated by 9 paise to 65.49 against the dollar in early trade on sustained selling of the American currency by exporters and banks amid increased foreign fund inflows.

Forex dealers said domestic equity markets opening with gains supported the rupee, but dollar's strength against other currencies overseas capped the gains. 

On Wednesday, the rupee had surged to its highest level in five weeks to end at 65.58 by gaining 38 paise against the US currency as exporters and banks stepped up dollar sales amid aggressive policy measures from the RBIMeanwhile, the benchmark BSE Sensex rose by 266.02 points, or 1.02 per cent, to 26,420.85 in early trade.

Sensex zooms 266 pts, Nifty above 8,000 on capital inflows

MUMBAI: The benchmark BSE Sensex climbed over 266 points and the NSE Nifty regained 8,000-mark in early trade on Thursday on buying in IT, pharma and banking stocks amid a firming trend overseas.

The 30-share index surged by 266.02 points, or 1.02 per cent, to 26,420.85 points in early trade. 

The gauge had gained 537.99 points in previous two straight sessions after RBI announced bigger-than-expected rate cut of 0.50 per cent to 6.75 per cent and announced other aggressive measures in its monetary policy review on Tuesday. 
All the sectoral indices, led by healthcare, FMCG and banking were trading in the positive zone with gains up to 1.11 per cent. 

The National Stock Exchange's index Nifty regained the 8,000-mark by surging 54.85 points, or 0.69 per cent to, 8,003.75. 

Brokers said sentiments turned bullish after RBI Governor Raghuram Rajan sprang a surprise by announcing a biggest-than-expected interst rate cut of 0.50 per cdent to 6.75, lowest in four-and-half-years to boost country's economic growth. 

Besides, a firming trend at other Asian markets following overnight gains on the Wall Street as investors bought recent beaten-down stocks boosted sentiments, they said. 

Japan's Nikkei moved up by 1.74 per cent in early trade Thursday, while financial markets in Hong Kong and China are closed on Thursday for a public holiday. 

The US Dow Jones Industrial Average ended 1.47 per cent higher in Wednesday's trade.
